Terms and Conditions

1. 1. Acceptance of Terms

By registering and creating an account on EDC Bookmarks, you expressly and unreservedly accept these Terms and Conditions. If you do not agree with any of the terms set forth herein, we ask that you do not register or use the service.

We recommend carefully reading this document before creating your account. Use of the service constitutes full acceptance of these terms.

2. 2. Service Description

EDC Bookmarks is a personal bookmark management service accessible through a web browser. The service allows you to:

  • Save web links (bookmarks) with their URL, title, and descriptive notes.
  • Organize your bookmarks using hierarchical groups and custom tags.
  • Search and filter your saved bookmarks.
  • Share bookmark groups through public read-only links.
  • Export your bookmarks in CSV format.

EDC Bookmarks is offered as a subscription service, with an initial 14-day free trial period.

3. 3. Requirements to Use the Service

To use EDC Bookmarks, you must meet the following requirements:

  • Be over 18 years of age.
  • Provide a valid email address and verify your account.
  • Provide a valid credit or debit card to activate the free trial period and, subsequently, the subscription. Payment is processed through Stripe.
  • Expressly accept these Terms and Conditions and our Privacy Policy.

4. 4. User Account

By creating an account on EDC Bookmarks, you acquire the following responsibilities:

  • You are responsible for maintaining the confidentiality of your access credentials (email and password). You must not share them with third parties.
  • You are responsible for all activities that occur under your account.
  • Only one account per person is allowed. Creating multiple accounts to evade payment conditions or any other service restriction is not permitted.
  • You must notify us immediately at me@edcilo.com if you detect any unauthorized use of your account or any other security breach.

The Owner shall not be liable for losses or damages arising from the user's failure to comply with these obligations.

5. 5. Subscription and Payments

Full access to EDC Bookmarks requires a monthly subscription under the following conditions:

  • Price: $2 USD per month (two United States dollars).
  • Trial period: 14 free days from the registration date. To activate the trial period, a valid credit or debit card must be registered. No charge is made during the trial period.
  • Automatic renewal: At the end of the trial period (or each billing period), your card will be automatically charged the subscription amount, unless you cancel before the renewal date.
  • Payment processor: All payments are processed by Stripe. By providing your payment details, you accept Stripe's terms and conditions.
  • Price modifications: The Owner reserves the right to modify the subscription price. Any price change will be notified at least 30 days in advance via the email address associated with your account. The new price will apply from the next billing cycle.

6. 6. Subscription Cancellation

You may cancel your subscription at any time from the Settings section of your account. The cancellation conditions are as follows:

  • Cancellation is effective at the end of the already paid billing period. No partial refunds are made for unused periods.
  • During the remaining period until the effective cancellation date, you retain full access to all service features.

• After effective cancellation, your account enters read-only mode. In this mode you can: • View and search your existing bookmarks. • Export your data in CSV format. • Access your account settings. • You CANNOT create, edit, or delete bookmarks, groups, or tags.

  • Shared links generated from your account will be deactivated at the time of effective cancellation.
  • Subscription cancellation does not imply the deletion of your account or your data. To delete your account, refer to the corresponding section in our Privacy Policy.

7. 7. Subscription Reactivation

If you have canceled your subscription and wish to reactivate it, you may do so at any time from the Settings section of your account.

Upon reactivating your subscription:

  • An immediate charge will be made for the new billing period.
  • Full access to all features is restored immediately.
  • All your data (bookmarks, groups, tags) remains intact and available.

8. 8. User Content

Regarding the content you store on EDC Bookmarks (URLs, titles, descriptions, group and tag organization), the following is established:

  • You retain all intellectual property rights over your content.
  • You grant EDC Bookmarks a limited, non-exclusive, worldwide, royalty-free license to store, reproduce, and display your content solely for the purpose of providing the service to you.
  • This license is granted only during the validity of your account and ends when your account or your content is deleted.
  • The Owner does not actively access, review, or monitor the content you store, except in the following cases: (a) when necessary to resolve a technical or support issue at your request, or (b) when there is a legal obligation or an order from a competent authority requiring it.

9. 9. Acceptable Use of the Service

By using EDC Bookmarks, you agree not to engage in the following activities:

  • Storing links (URLs) that direct to illegal, fraudulent, defamatory content, content that infringes third-party intellectual property rights, or that promotes illegal activities.
  • Using the metadata extraction functionality (scraping) to extract bulk content from third-party websites without authorization.
  • Attempting to circumvent, disable, or breach the service's security measures, including database-level security policies (RLS).
  • Performing reverse engineering, decompiling, or disassembling the service's source code, except in cases expressly permitted by applicable law.
  • Sharing your access credentials with third parties.
  • Creating multiple accounts to evade payment conditions, subscription limitations, or any service restriction.
  • Using the service to send spam, phishing, or any type of unsolicited communication.
  • Performing activities that generate a disproportionate or unreasonable load on the service's infrastructure.

The Owner reserves the right to suspend or cancel any account that violates these acceptable use conditions.

10. 10. Intellectual Property

All intellectual property rights over EDC Bookmarks, including but not limited to:

  • The "EDC Bookmarks" brand and its logo.
  • The source code, software architecture, and algorithms.
  • The user interface (UI) and user experience (UX) design.
  • Documentation, legal texts, and any other original content of the service.

Are the exclusive property of Eduardo Cifuentes López. The reproduction, distribution, modification, or unauthorized use of any of these elements is expressly prohibited without the prior written consent of the Owner.

The names, logos, and trademarks of third parties mentioned in the service (Stripe, Supabase, Vercel, Resend, Google, among others) are the property of their respective owners and are mentioned for informational purposes only.

11. 11. Limitation of Liability

EDC Bookmarks is provided "as is" (AS-IS) and "as available" (AS-AVAILABLE). Within the limits permitted by applicable law:

  • We do not guarantee that the service will be available uninterruptedly, be completely secure, or be error-free. We make reasonable efforts to maintain high levels of availability and security.
  • The Owner is not responsible for the content of the URLs you store on the service. You are solely responsible for the links you save and for verifying their content.

• The Owner shall not be liable for losses or damages arising from: • Temporary service interruptions. • Data loss caused by catastrophic failures, although reasonable protection and backup measures are implemented. • The content or actions of third-party service providers. • Any use you make of content exported from the service.

  • The total liability of the Owner for any claim related to the service is limited, to the maximum extent permitted by law, to the total amount paid by the user in the last 3 months prior to the event giving rise to the claim.
  • Nothing in this section is intended to limit or exclude liability that cannot legally be limited or excluded under applicable law.

12. 12. Account Termination

The Owner reserves the right to suspend or terminate your account under the following circumstances:

  • Violation of these Terms and Conditions or the Privacy Policy.
  • Fraudulent or illegal use of the service.
  • Non-payment after the corresponding collection attempts.
  • Request from a competent authority.

In the event of termination for violation of the terms:

  • The user will be notified at least 5 days in advance, except in cases of serious violations that warrant immediate suspension or termination.
  • The user will have a period of 15 calendar days to export their data in CSV format before permanent deletion.
  • Shared links generated from the account will be deactivated.

Account termination does not exempt the user from any outstanding payment obligations, if any.

13. 13. Applicable Law and Jurisdiction

These Terms and Conditions are governed by and interpreted in accordance with the laws of the United Mexican States.

For the resolution of any dispute, difference, or claim that may arise in connection with these Terms and Conditions or the use of the service, the parties expressly submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.

14. 14. Modifications to the Terms

The Owner reserves the right to modify these Terms and Conditions at any time. The procedure for modifications is as follows:

  • Users will be notified via email at least 15 days before the new terms take effect.
  • The updated version will be published on this page with the new "Last updated" date.
  • Continued use of the service after the effective date of the new terms implies full acceptance thereof.
  • If you do not agree with the modifications, you may cancel your subscription and delete your account before the new terms take effect.

We recommend periodically reviewing these Terms and Conditions to stay informed of any changes.
